Petitioner absconding in RCR case at evidence stage
19-Jan-2025 (In Divorce Law)
Due to extramarital affair and false ego, Wife left on her own deserting husband and kids but filed RCR(with all false allegations) after 2 years to avoid desertion grounds. Husband filed reply contesting the false claims and also claimed divorce relief under section 23A.
Now case is in petitioner evidence stage and now wife/representing lawyer not coming to court on hearing dates. As this is purely to drag the case for long time, please suggest on what husband can do here take advantage of?
Dear Sir,
You can file an application before the Family Court or approach High Court to get your case disposed as early as possible since as per amended Section 21B of HM Act. Family cases needs to be disposed of within six months. The High Court may give directions to the Family Court to dispose of your case within next four to six months irrespective of whether your wife or her Advocate appears before the Family Court or not.
