Permanent child custody case filled by father.

13-Aug-2025 (In Divorce Law)
My husband has filed for permanent and interrim child custody of my 8 year old daughter. How much percent of chances are there that he will get it provided neither the kid nor myself agreed to this. And what should I do to avoid this.

For an 8-year-old girl, courts in India usually keep custody with the mother unless she is proved unfit. Since your daughter is living with you, and both you and the child do not agree to give custody to the father, his chances are low. To protect custody: Show proof you give her a safe, stable, and happy life. Keep school, health, and home records ready. Tell your lawyer to request the judge to talk to your daughter privately, so the court knows what she wants. Even if he does not get custody, the court may still give him visiting rights.

It is highly unlikely that he will get custody of the minor daughter. However, it depends heavily on the grounds he has filed application on. If he has filed application on strong grounds such as alcoholism and mental illness, he may get custody.

Permanent Custody of Child is not easy, considering, your 8 years old Daughter is still small enough to decide in terms of maturity, that, with whom, she wants to live, whether with Father or Mother! Hence, the Court may give Joint Custody of the Child or may give Visitation Rights to one party and permanent Custody to the other party.
