Application under Sec 25 of Hindu marriage Act can be rejected if the spouse is earning more than her husband, if she is getting additional income source from her assets or business and if she deserted her husband without valid reasons or if she is capable of living her livelihood without dependence and if she is well qualified with having a qualifying degree

Under this Section 25 of HM Act either spouse may claim permanent alimony depending upon health condition and other conduct of the party on the basis of source of income and assets possessed by the other party. Immovable properties may be taken into consideration to determine the quantum of alimony.
