Payment of maintenance in case of being jobless for 1.5 years

Hi I have been jobless for 1.5 years. I have 2 joint properties with my father.he only invested in it.due to his old age he asked me for joint registration. My wife filed 498a in 2009 and deserted me.immediately she filed 125 CrPC. I got acquitted from 498a and no appeal is pending against it. My divorce appeal is pending before the high court Bangalore. Since I have been maintaining the child my parents and myself. I stopped her maintenance after I lost my job . She has been earning 33500 RS pm. I don't have any income and just hold those properties which in reality my father own. Can court still ask me to pay her maintenance though I don't have job and income? I told court I will maintain the child but cannot maintain her.and she is earning better salary than me.

Since you are not having any income so Court may not ask to pay maintenance Your wife earning handsome of salary there by she is not entitled for maintenance if magistrate orders for maintenance then prefer an appeal

At ant cast you cannot avoid maintenance order whether you have job or not your liability starts on the day you involve in legal binding ,court will not consider your contention of not having job and you have property along with your father, the court will only see that you are the legally owner and the document clear shows, so your wife has right to create charge on half of the property.
