Payment of child Maintenance in multiple cases
25-Dec-2024 (In Divorce Law)
I have to pay rs. 5000 per month maint. U/s 125 crpc in family court from 2012 to 2020 for the child. I am already paid interim maint. to him in DV case in separate district court for period 2016 to 2020 at rs. 5000per month. How can I adjust payment made against DV case to 125 crpc case to avoid multiple maint. Pls guide.
If there are any change in circumstances you can cam file an application for the same and can change the maintenance amount
Please mention. Court making later order to consider the already paid amount.
But need to know the order and what has made the second court to pass an order
Then only can comment on adjustment of amount for maintenance

Well, you have to produce such Supreme Court Judgement, which talks about maximum cap of Maintenance to be granted by Courts to Wife, in multiple cases filed by her to seek Maintenance, in which, Judgement SC also tells, payment can be adjusted from one Maintenance offered in one case to another case in which Maintenance is claimed to maintain the maximum cap of Maintenance to be provided to victim women by her Husbands on Court Orders.
