A defamation case, even if false, must be handled formally and strategically, especially when an embassy seeks clarification. Immediate Legal Position: 1. Do not panic. Mere registration or filing of a defamation case does not amount to guilt or conviction. 2. Verify the status of the case — whether it is only a complaint, an FIR, or a case taken cognizance by the court. 3. If the allegations are false, vague, or unsupported, you have the right to seek: Quashing of proceedings, or Discharge at the appropriate stage. Embassy Clarification: The embassy generally requires a legal clarification letter/affidavit stating: Nature and stage of the case That the matter is sub judice / contested That there is no conviction or adverse finding against you Such clarification must be drafted carefully by an advocate to avoid prejudice. Do not submit self-drafted explanations or informal statements, as they may be misinterpreted. A precise legal response and documentation can effectively resolve embassy concerns without impacting your rights.

Do not panic. First, obtain complete details of the alleged defamation case, including FIR number, court details, and present stage. The embassy usually requires a clarification affidavit explaining the facts and confirming whether the case is pending, quashed, or falsely filed. After verifying records, you can prepare a proper affidavit with supporting documents. It is advisable to consult a lawyer to examine the complaint and guide you on appropriate legal steps, including quashing if the case is false.
