Passport impound during matrimonial case

27-Dec-2024 (In Divorce Law)
I got married in March 2024, but my wife has been living with her mother for a month, refusing to return. She’s insulted my mother and made false domestic violence accusations. I fear she might file a false case against me, which could affect my job. If that happens, could my passport be seized or prevent me from traveling abroad for work? My financial situation is already fragile, and I’m concerned about the impact.

Dear Sir, Normally, spouse cannot file Divorce within a period of 12 months from the date of marriage unless there are special grounds like non consummation of marriage or marriage was happened due to fraud played by other side. If any criminal case filed then immediately approach High Court and get a stay upon such false case. Thus, you can go to Abroad. In rarest of rare cases passport will be seized not in your case.

There are every chances once criminal case registered its impact on your visa and passport renewal process, yours is a family dispute so you can seek court interference and seek relief in the event if you face any passport related issues
