Ownership of house bought in joint name by both husband and wife

22-Dec-2023 (In Divorce Law)
Dear Lawyers, I have a question regarding ownership of property bought in the joint name of both husband and wife, where down payment has been made in such a way that wife had 80% share and husband had 20% and EMI is paid by wife. Both earn equally and husband takes care of major household expanses while wife takes care of travel and extra as well as personal expenses. ( married for 2 years and no kids) Who has ownership of the property? how can it be divided between husband and wife in case of dispute/divorce?

Dear Madam, Since you are paying 80% EMI as such you are the owner to that extent unless husband proves that he is spending his salary amount on the house expenses thus Court may decide on merits at the most both of you entitled for 50% each.

Sir/Madame ownership according according to you r set of facts we in law call it as joint ownership. Me as a lawyer would like to state in cases like yours it would be best to sell the property or and share the amount on 80-20 basis or either of the parties pays the either sides share and relinquishes their right over the property.
