Ongoing 125 crpc getting delayed

28-Mar-2024 (In Divorce Law)
I want to file for divorce after 8 years of separation. We have a 7 year old daughter. Wife filed 125 crpc but has never appeared in court whenever needed. It is only me travelling 12 hrs for this. My concern is if she files multiple cases on me then i may go bankrupt by just paying the fees and travelling cost. i am currently out of job. Kindly advice how should i take it from here. Her lawyer had proposed mutual divorce for a huge alimony which i refused.

in this case it is not required that u have to attend the court on each date, only at the time of evidence and conciliation you can be present, further if your wife is working and having good income , you can also ask for permanent alimony under section 25 of Hindu marriage act, further you can file for divorce on ground of desertion and cruelty, you can file the divorce petition in place where marriage was performed, or where your wife resides or where both of you last resided, and as far as 125 case is concerned you have to contest and fight it and see that no maintenance is granted to her, but as far as child is concerned you may be liable to pay , as both husband and wife are both liable to maintain child.
