02-Jul-2026 (In Divorce Law)
One of my lady friend is going through mental trauma these days and seeking help. Her husband doesnt allows her to move out of house, and she want to get separated. She was married at a temple few years back and there no court marriage done. Sometimes he also beats her and give her mental trauma, checks her phone all the time, So, does she has the right to file for divorce on grounds of cruelty, Can she live separately from him, and if yes than can his husband forcibly take her back to his home?

Yes. If the marriage was performed according to Hindu rituals in a temple, it is generally a valid marriage even without court registration. On the facts you've shared, physical assault, mental harassment, controlling her movements, and checking her phone may amount to cruelty, which can be a ground for divorce. She has the legal right to live separately and cannot be forcibly taken back by her husband. If she fears violence or harassment, she can also seek protection, residence, maintenance, and other reliefs under the law. She should consult an advocate with all the facts before taking legal action.

Yes, if the marriage was solemnized according to religious ceremonies (such as a temple marriage with essential rites), it is a legally valid marriage even without court registration. If the husband has been physically assaulting her, subjecting her to mental cruelty, controlling her movements, and invading her privacy, these facts can constitute cruelty and she may file for divorce on that ground, subject to evidence. She has every right to live separately for her safety and dignity. Her husband cannot legally force her to return to the matrimonial home against her will. She may also seek protection, residence orders, maintenance, and other reliefs under the Protection of Women from Domestic Violence Act, 2005, and can lodge a police complaint if violence continues. She should consult a local family lawyer with all relevant facts and documents to take appropriate legal action.

Based on the facts shared, your friend's situation squarely falls under both matrimonial and domestic violence law. A marriage solemnized as per Hindu rites and customs (including a temple marriage) is legally valid and binding even without separate court/civil registration, so she is entitled to all legal protections available to a lawfully wedded wife. Cruelty, whether physical (beating) or mental (constant surveillance, restriction of movement, confinement), is a recognized ground for divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1955, and she can file a divorce petition on this basis. Additionally, she can invoke the Protection of Women from Domestic Violence Act, 2005, which allows her to seek a Protection Order, Residence Order, and monetary relief from a Magistrate, and she has an absolute right to reside separately from an abusive spouse — the husband cannot forcibly compel her return, as this would itself amount to further cruelty and could attract criminal liability under Section 498A IPC (now BNS provisions) for cruelty by husband/relatives. She should first lodge a complaint with the local Protection Officer, Women's Helpline (181), or police, preserve evidence of abuse (medical records, messages, witness statements), and simultaneously initiate divorce and DV Act proceedings together for comprehensive relief.
