How can I file contested divorce as an NRI married in India.I have a child who is born in USA, so how does child custody work in my case.
you can file contested divorce petition better immediately later one more petition you can file G&wc for children custody matters both proceedings are different you can file immediately restitution of conjugal petition better then court will issue notice to again

You can file Divorce case in India though your husband is an NRI. Because your marriage took place as per Hindu Marriage Act which is not known to Abroad Courts. However, you can claim custody of child as per the law of the Country where your son was born.
