Hello. Yes, you have legal remedies. If your NRI husband has not paid maintenance for the last year and you are unemployed and unwell, you can file a maintenance case and seek interim maintenance from the court. If you are unable to afford a lawyer, you may also be eligible for free legal aid through the District Legal Services Authority. Please share your marriage details, current residence, your husband's country of residence, and whether any case is already pending. I'll guide you on the best legal course of action. — Advocate Anmol Sharma

You have strong legal remedies available to secure maintenance from your NRI husband despite the jurisdictional challenge. Under Section 125 CrPC (now Section 144 BNSS) and the Protection of Women from Domestic Violence Act, 2005, you can file for interim and permanent maintenance in the Family Court/Magistrate Court in Faridabad, where you reside — Indian courts have jurisdiction even if the husband is abroad, since these are civil enforceable orders and NRIs can be served through the court process, embassy, or even substituted service if he avoids summons. You can also pursue maintenance under Section 24 of the Hindu Marriage Act, 1955 if divorce/judicial separation proceedings are contemplated, and seek attachment of his Indian assets or bank accounts if he defaults on court-ordered maintenance. Regarding free legal aid, since your financial condition has deteriorated (job loss, illness, exhausted funds), you qualify under the Legal Services Authorities Act, 1987 for free legal representation — approach the District Legal Services Authority (DLSA), Faridabad, or Haryana State Legal Services Authority, who will provide a panel lawyer at no cost to file your maintenance and DV Act petitions. Please gather marriage proof, income/asset details of husband, and medical records to strengthen your case when approaching DLSA.

Yes. Being a woman, you are entitled to free legal aid under Section 12(c) of the Legal Services Authorities Act, 1987, irrespective of your income. You may approach the District Legal Services Authority (DLSA), Faridabad, which can provide a panel advocate free of cost. National Legal Services Authority +1 You can also file appropriate proceedings for maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 125 Cr.P.C.), seek interim and permanent maintenance under the Hindu Marriage Act, 1955 (if applicable), and claim other reliefs under the Protection of Women from Domestic Violence Act, 2005, depending on the facts of your case. If your husband is an NRI, the court can still issue process against him through the prescribed legal procedure.
