If your wife had filed 498a case against you and your family then definitely you can file a divorce case against your wife. You may file for contested divorce on the ground of cruelty on the basis of cruelty mated out to you by and her filing a criminal case of 498A against you. Whether Mumbai court have jurisdiction for divorce case depends on few facts.
