Need to file 340 CrPC against my wife arising of 125 CrPC case

Can I file 340 CrPC case against my wife as she has taken interim maintenance order from the court while she was working at a school during pendency of the case. In the RvN affidavit she showed housewife and income 0. While she joined the school later and I have RTI showing she joined the school, she has also already left the school.

So for that you can file an appeal against the order of the Magistrate alongside a 340 Crpc application for false affidavit and suppression of material facts. The same has to be done supported by proper documents.

it's unclear whether your wife has joined or left school. the salary of you and your wife will be under consideration. if your wife has a government job then we will look into the matter. if not there are different rules.

Section 340 CrPC relates to procedure in cases of false evidence given in a judicial proceeding. If your wife has provided false info about her income or employment in an affidavit or during a court case to obtain an interim maintenance order, it could potentially constitute an offense under the IPC . Your possession of RTI documents showing your wife's employment history could serve as evidence of the alleged misrepresentation.
