In Muslim law, Khula is also an option, which can be initiated by the wife, subject to conditions and mutual consent. However, if the husband does not agree, you may still approach the court for appropriate relief including divorce on grounds of cruelty, fraud, or unsoundness of mind.

Khula can be initiated by you, it can be sought when continuation of marriage becomes difficult or intolerable. In your case, if there were material facts hidden from you regarding your spouse’s mental health condition before marriage, it can be considered a valid ground as it affects free consent and the very basic foundation of the marriage. You may first attempt Khula through mutual consent. If the husband refuses, you can approach the Family Court and seek dissolution of marriage under the Dissolution of Muslim Marriages Act, 1939, particularly on grounds such as cruelty, fraud, or inability to fulfill marital obligations.

Yes, if concealment of mental illness or incapacity before marriage is proved, you may seek Khula by mutual consent or dissolution through court. Keep medical proof, messages and consult a family lawyer.
