Need Legal advice for Divorce and maintenance

11-Jun-2023 (In Divorce Law)
I got married in 2015 and have a 3 year old daughter. My husband is a government school teacher and is respected by many in his area. But he is very verbally abusive in person. He is a sadist who likes to blame for all his problems to anyone specially me, his wife. He has trust issues and does not respect my parents and my family. He tries to dominate me in many matters. The question arises why am I in this marriage. It is because I am a housewife with no job , with a daughter whose expenses I will not be able to meet. And also we do not have a legal marriage certificate since he has no time to apply for it. So pls suggest, if I wish to leave him, what steps shall I take to atleast he agrees to incurr the expenses of my daughter.

You can give a written complaint in your nearest police station about domestic violence. all the things you have mentioned comes under domestic violence and it is one of the ground for divorce. And you can also apply for maintenance under section 125 of Crpc. for further details you can visit my chamber or call me.

Mam you don't require marriage certificate in order to file maintenance case, domestic violence or even divorce case. Marriage under the religious law is recognised by the law and therefore they are also treated as legal marriage. If you are not happy with your marriage therefore you can opt for judicial separation. Please contact me so that we can have a discussion on how to prepare for your case Regards J.K Bhuyan
