If your petition under Section 528 BNSS (or Section 482 CrPC, depending on when it was filed) is already pending before the High Court, your lawyer can consider: Mentioning the matter before the appropriate Bench for urgent listing. Filing an application for early hearing, explaining the urgency (for example, charge-sheet filed, summons issued, elderly parents, employment consequences, etc.). Seeking interim protection if it has not already been granted. Requesting stay of further proceedings before the trial court, where legally justified. Whether the High Court grants an expedited hearing depends on its roster, urgency, and pendency.

If you have already filed a quashing petition before the Hon'ble High Court, the next step depends on the present stage of the petition, such as admission, notice, or final hearing. In appropriate cases, an application for urgent listing or early hearing may be considered. Simultaneously, your defence in the trial court should be handled carefully, including seeking exemption from personal appearance where legally permissible, contesting any interim applications, and preserving all documentary and electronic evidence supporting your defence. If the allegations are demonstrably false, a well-planned legal strategy can be adopted both before the High Court and the trial court. A detailed review of the FIR, charge-sheet (if filed), the quashing petition, and the connected matrimonial proceedings is essential before advising the best course of action. You may discuss the complete facts and documents for proper legal guidance and an effective case strategy.
