Need help to file a divorce petition
08-Jan-2025 (In Divorce Law)
When I got married I was Hindu. That was in year 2005.
I have accepted Islam an year ago .
Can I marry a Hindu girl without giving the divorce to first wife.
Under Indian law, marrying a second time without legally dissolving your first marriage constitutes bigamy, which is a punishable offense under Section 494 of the Indian Penal Code (IPC). This holds true even if you have converted to Islam, a religion that permits polygamy. Therefore, to lawfully marry a Hindu woman after your conversion to Islam, you must first obtain a legal divorce from your first wife under the Hindu Marriage Act, 1955. Proceeding with a second marriage without securing a divorce would be illegal and could lead to criminal prosecution for bigamy.
