Need help in maintenances case filed by my wife

On last February my wife went to relatives house. When she came back my dad told her . You should wear traditional Indian dress “ chudidar” while going to relatives house . For this she fought with me and my parents and drank good night liquid . We admitted her to hospital after discharge. She went to her home and now she is staying there for 11 months . Today I got crpc 125 (1) a & b notice. Help me how to proceed with this . I have even called her 2 or3 times to come back she is not willing to come .

The case under Section 125 is for maintenance. She has filed this case for monetary compensation. You need to respond to the notice by engaging a lawyer and attending court on the given date without fail. Since its filed under the criminal procedure code (crpc) absence in court can lead to difficult conditions for you as it will be reported that summons/ notice has been served to you. So you can contact us or any other lawyer and ensure your presence is noted on the next hearing date. Secondly you can inform the court that she is not willing to return home and to refer the case for mediation that is court appointed settlement discussions. During such discussions with the help of a neutral party (Court appointed mediation) you can try to resolve differences or take decisions accordingly.
