04-Aug-2024 (In Divorce Law)
My wife fled sec9 and I filed sec13 1ia. Court counseling failed. No kids. Basically She was not interested in me from day1 of our marriage. Her family indirectly demanding 50 Lakhs. But I have private job. She also doing job. Only my parents have the property getting from their parents. Is she get share in my parents property if they died. What things we need to do because I can't give her 50 lakhs. My capacity is max 3-5 lakhs to her signature in divorce papers.

For getting divorced from your wife you need to file a petition for the same. Also your wife can claim some maintenance from you either by way of lump sum or monthly. Feel free to contact me for seeking any further legal advice as regards the same.

Well, if your Wife does not become ready to Divorce you, then you have to contest with her in Court for years to take a Divorce. You have to prove in Court, that, she was never interested in you and never wanted to perform obligations of wife, considering that, it is crystal clear, that, she just wants to harrass you, so there lies no meaning of living with her, by convincing court in this manner, you can seek Divorce.

You have to fight this out. She won't agree with the 3/5 lakhs. She can't claim share in your parents property. There needs to be evidence filed to support your less income. There are many judgements which establish that if a wife is working she can't ask for maintenance.
