Need help-Divorce and property settlement

30-Jul-2023 (In Divorce Law)
I want to file a divorce case. There is a domestic violence case ready going on which state government is fighting on my behalf. I got to know that I have to file a seperate petition for divorce. Problem is The house I stay is in joint ownership. I am primary owner and my husband is secondary but since we bought this house I am paying loan installments, loan is in my name and I am residing at the property. So want to know how can I remove his name from this property as he is not paying anything.

The law is that if the husband and wife are jointly owners of a property, then if the other party wants to take possession of his property, then he will have to share it, whether he transfers it to himself through a letter of donation or benami. by or by willOtherwise, your husband can also write a relinquishment release in your favor.

There appears to be myriad contingencies in this case, the proceedings back to back events, largely the joint ownership and the loan being in ur name..Regarding having done away his name with, would require a plethora of law within the parameters of Transfer of property act and other appellate court ruling, after having a conversation with you may be I could be of some help to you
