Need advice to file a case against my husband

My NRI husband is ex parte in dv act case and he is not paying maintenance ordered by court. I have filed execution case in same court but he owns nothing in India. So, i have some questionsn1. Will judge file any case or charges against him for not paying maintenance. If yes, then what will be the charges?n2. Can I file police case against him like section 406 or others while DV act case is already in courtn3. What do you suggest.nPlease answer
