Need advice on filing case of mental harassment against wife

there were lot of disputs between me and my wife, got married in 2012 and have a kid but there were no marriage like relationship between us. we have no understanding, no commitment. now she decided to leave home in may 2017 with kid. now she filed a complaint in Woman Police station against me. should i file a case against her too for mental harassment and fraud as she has taken cash , jwellery and lands paper with herself.

You may file FIR for all valid reasons and you may also file petition for dissolution of marriage. You may also file petition for restitution of conjugal rights if you want to bring her back at your home and if she doesn't want to come back you may proceed further for divorce.

you can file a case for theft for cash , jewellaries and land document if she has done that. but what fraud she has done, no fraud seems prima facie. and also you can not file case for mental harrassement but on the basis of mentle harrassment you can file divorce petition.

Hi based upon your future planning you do have to proceed , firstly in the women police station you can put your stand , further on you can file section 9 application ; case of fraud ; divorce under section 13 .
