My wife threatened to file a false police complaint against me and my family for dowry and domestic

17-Jul-2024 (In Divorce Law)
My wife threatened to file a false police complaint against me and my family for dowry and domestic violence. We've been married for 10 years and have two kids (6 and 3 years old). Can my wife file a false complaint for dowry after 10 years of marriage? If she files a domestic violence case, does she need to submit proof, or are verbal allegations enough? Although there have been many fights during this period, no formal complaints were filed with the police or court. However, I have provided some written information to the police regarding the fights and false allegations. If I file for divorce, what problems (cases) and issues might I face from her side? If I file for divorce under cruelty because she abuses me and my mother, do I need to prove these claims? Kindly help regarding the same. Thanks a lot.

Yes, there is no limitation of number of years of marriage on filing 498A. However, that doesn't mean that a wife or her relative can a file section 498A on the husband anytime they wish. As per CrPC 468, the limitation on filing of 498A is 3 years from the last alleged incident. Yes a petition for divorce filed on the ground of cruelty needs to be comprehensively be proved.
