My wife is suicide my child girl baby (6) years old my child is mother parent control I have not seeing my baby around 4.5 months
You have a right to seek custody or visitation rights for your child under the Guardians and Wards Act, 1890. Under Section 6 of the Hindu Minority and Guardianship Act, 1956, the father is the natural guardian of a minor child after the mother.
You can file a petition under Section 9 of the Guardians and Wards Act, 1890 before the appropriate Family Court seeking custody or visitation rights. The court will consider the welfare and best interests of the child, and may grant visitation or shared custody, especially since the child is very young and needs both parents' love and care.
If the child’s maternal grandparents are not allowing you to see the child, you can also file an interim application for immediate visitation rights under the same Act.
