My wife is so stubborn and not ready to come back.

15-Jul-2023 (In Divorce Law)
Hi I got married in dec 2017 and after 30 days I was back to Canada to continue my job, mean time my was also pursuing her masters in India. Due many unforeseen conditions I had to return back to India after one year of marriage. After coming back to India I had asked my father in law to bring my wife back, but they and she both refused to come to native place as she wants to stay in metropolitan city. It’s been 3 month I’m in India and I’m calling her to come to my place, but she’s not ready for that. One time his father also tried to file a fake complaint against me, but that wasn’t went well to them. Can I send legal notice for asking her to come and join me? Or any other better ways to approach. (She wants to work in private companies only, I even suggested her that will start a nice business here together, she’s not ready for that) in 1.5 years of marriage we were hardly together for 20 days and her family also threatening for DV/dowry cases on my family.

Sir, you are genuinely wants to her to come back to matrimonial home and lead marital life, then you have option to file matrimonial case against yours wife for the relief of restitution of conjugal rights. Before filing of the case, you issues a legal notice though an advocate for her response. Wait for some time for her response to the legal notice. if she wants to continue with the marriage and joine to the matrimonial house, then problem will not be much. if she does not wants to continue with marriage, then you have two option, one is need to file case for restitution of consugal rights, and onother one is that you better to file divorce case. choose yourself and go ahead. for further information please contact.

You can file a case for Restitution of Conjugal Rights that is, asking for the court's intervention to direct your wife to join you. Once the petition is filed, she will receive court summons and has to come to court. At that point you can discuss the issues and take the court's help to rejoin your wife

You could file a petition for restitution of conjugal rights.
You will have to prove that she is refusing to reside with you for no reason .
The court will direct her to resume conjugal relationship with you
