if the wife refuses to sign the second motion of divorce through mutual consent then the court has no other option but to dismiss the petition and leave the parties to explore alternative remedies such as contested divorce.

You can either convince her to do second motion or else you can file the suit for recovery for the payments you have given ! You can show her conduct in case you file contested divorce case ! You need to hire expert advocate for your case! Plz b in touch

If a settlement deed was executed between you and your wife before filing of mutual divorce , then she has to honour those terms and conditions. Otherwise you can file a contempt petition in the same family court and get that amount back if she is not desirous to join second motion.

If your wife has taken the money and not coming before the court then you can always serve her a legal notice and warn her that either return the money back or sign the divorce decree or face legal action which will be at your own risk. And if you wish to go legal then it attracts the breach of contract and you can also file a recovery suit. For more legal assistance I am just a call away.
