My wife filed false affidavits in two courts

06-Apr-2024 (In Divorce Law)
Hello, My query is that my wife filed false affidavits hiding her education and bank account details in DV and 125 CRPC. I've submitted proofs of her educational certificates and bank details in the courts. Now for this should I file an application against her in the two separate courts or should I file a fresh single case against her submitting her false affidavits from the two cases? she is continuously misleading the courts from the very beginning.

so you must have hired an advocate who is pleading on your behalf why don't you take the opinion from the advocate itself. giving false affidavits can be challenged but you should consult your lawyer as there might be something else also

Yes...you need to approach both the courts and submit disclosing the contempt of court done by your partner. It's already in the income affidavit. And if there's no scope of living together then rather than stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of six months.

If at all you are convinced that all the documents are blatantly false, then you do have an option of moving an application of contempt. Also, you can file a criminal case under the relevant penal sections against your wife for forgery.

As you told there are two separate cases and they must be pending before two different courts so of course you do have the option of filing application for perjury before both the courts and each of respective court shall deal it with accordingly. so it is suggested that you move two seperate application

You should seek assistance and Consultation from an Advocate having expertise in matrimonial laws. There is a tendency in matrimonial disputes to conceal the real income and other relevant details. However if she had filed a false affidavit she is liable for perjury under section 340 Crpc. Further application can be filed seeking permission to put interrogatories and to produce relevant documents aa per supreme court judgment
