What is the status of your divorce petition filed on the ground of cruelty. Do engage a lawyer and seek a detailed legal consultation for your 498a matter as it is a criminal case where imprisonment can also be awarded in case judgment goes against you and your family members. Do connect with better particulars

Hello, After filing a 498A FIR, the police will record statements and subsequently file a charge sheet. Once the case reaches the court, you will need to secure bail. It is important to note that there is no direct connection between a 498A FIR and divorce. To initiate divorce proceedings, you must file a separate petition under Section 13(1)(ia) of the Hindu Marriage Act on the grounds of cruelty. Adv Jayatee Chatterjee

It all depends on the reply you would have filed in the cases that were filed your wife against you. Having said that, your statements made in all the cases have to be considered by the court, which would deal with the case of section 498a. Outcome of the cases which are already filed by your wife would also have a lot of impact.

If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
