My Son - Daughter in Law- Kids

Dear Sir/ Madam, My son has been in living relation with Uma since last 14 to 15 years and they have two kids and frankly speaking my son has always been aggressive , wherein now he and Uma had a fight and she left with the kids to mumbai to her mother place, my son has been pleading and requesting her to come back but she is adamant not to come back , this has put up my son in a very disturbed state of mind and he is ready to do what so even his wife wants him to do , as she is not at all ready to come back to him , i want to know how can i get the custody of the kids as there future is at stake , Kindly advice as whats the course of action to be taken up in resolving the issue , Son is now at Vizag and Uma and kids are at Mumbai . There is no legal marriage between your son and Uma as per the information you have provided. The children are born out of live in relationship. Your son can claim that the said children are born out of the relationship with that lady (Uma). They are his children. For the better care, wellbeing and better life of the children he can file a petition for the custody of the kids if they are minors in the competent court.

your son can bring back his children to his custody by filing a petition (Guardian and Wards OP) in Mumbai District/Family court by approaching a good lawyer at Mumbai.
your son also can file a petition for restitution of conjugal rights at visakhapatnam family court or a court having jurisdiction in your native place..
