My partner is not willing to give Divorce, Is there any option

i cant tolerate his behaviour. He didnt take me and my kids for more than 5 years, after am getting a job in dubai he cam back trying to prove that he loves us. but still he didnt do anything for me and my kids. He is paying only 10000 indian money only in this past three years.Aprat from this he dont have any love or affection to us. I cant live with him. I told him that i will file divorce but he is threatening me that he will get my kids from me and he will not give mutual divorce.what i will do
file divorce against your husband stating all the atrocities committed by him against you during the whole marital life with him immediately shall be the only solution in your favour to get rid of the total problems caused to you

on case of child custody both of you are eligible to get the custody. But the mother's right is higher than the father's right in respect of child custody. O suggest you to file divorce rather than mutual divorce. If your applying for mutual divorce, some time he may change his mind and impose certain condition up on you.
