15-Nov-2024 (In Divorce Law)
My mother is a victim of domestic violence. She face mental torture everyday . She is the bread earner of the house and my dad don't do anything still abuses her so much . I am her daughter . I am still a minor and living in other state . I want to help my mother out as she is not filling complaint against him because of my 5 year old sister. But because of this the mental health of my mother and sister is getting worse day by day . Please help me out what can I do?
Your mother have so many options in law like domestic violence case, per month maintaince amount case ,harassment case against your dad but i think if your mother don't want to do anything against your dad so just make a complaint application and give the application to mahila thana and police station then police will give him lesson. I mean try to scare your dad
Hello... Being an advocate i just suggest you to do an FIR, but before lodging any FIR, police officers call both the parties for counseling 2 times, thereafter the party against whom (your father) the FIR was being registered will be warned to take care of victim(your mom). and after 2 counseling sessions if your father still not take care and keep your mom in good condition, then FIR be lodged against your father. If you don't want your father being arrested for his malpractice or cruelty against your mom, then there is no legal solution. If you want to safeguard your mom you have to take a proper legal action against your father.
