you can file in High Court for stay . there is no need to have NOC from your previous lawyer of District Court . you can choose any another lawyer .who may file in High Court for stay . for the documents , You can apply for certified copy of full files from the concerned district court. if you want another lawyer in the existing case .in which your existing lawyer refused to represent you. you can engage another lawyer .He/she will file his Vakalatnama. Most probably, your existing lawyer will not object. if he object then let him object before the court wherein you can ask him for NOC

The process is simple. You need to settle his balance amount if any and ask him to give NOC. As per law, your lawyer should provide you with the briefs handed over by you to him along with NOC in writing. Then, you are free to engage a new lawyer for your case. Good luck!

Lawyers cannot withhold your files for any reason (eg payment of fees) in case lawyer refuses to give NOC move to court to dispense with requirement of noc. hire a new lawyer and he will intimate your old lawyers that you aren't continuing with him. Feel free to contact me for more assistance.

you have to talk to your ex lawyer for NOC. If you have cleared your dues with earlier lawyer then he must give you file and documents, if not then approach bar association where he is a member of. They must certainly help you to get your files back.

Although it's advisable to get NOC from your last lawyer but same is not compulsory. You can alway make an affidavit in regards to the same and file it with vakalatnama of your new lawyer. If you face any issue in regards to NOC talk to the new lawyer you are hiring. Alternatively you can connect with us for help
