My husband sent me a notice for mutual divorce

10-Aug-2023 (In Divorce Law)
My husband has sent me notice for mutual divorce with all the false allegations. What should I do next? He is not even giving me maintenance or has taken any responsibility since separation. Last month he even promised to come and live together but then he went to his native place and changed his mind. What step should I take now?

You can do two things. If you wish to stay with him and continue the marriage, you can file a petition for restitution of conjugal rights before the Family Court. However, if you too feel there is no meaning of your marriage with him, you can reply to the mutual Divorce notice stating the terms and conditions on which you can divorce him. The terms and conditions would include maintenance, child custody if any, things brought by you during marriage and all other valuables that belong to you. You and your husband together have to agree to the terms and conditions mutually and then only file for mutual Divorce. For further assistance, you can approach me.

The steps to be taken depends entirely upon your decision. Steps will be suggested according to your demand and requirements. You have to answer the notice sent by your husband and deny the levelled allegations.

Well, if your Husband does not want to live with you, then, there lies very little chance, that, he may change his mind, considering, you might have tried several ways to plead him, to request him, to make him to happy, to leave his demand of Divorcing you, but, he didn't agree, so, I think, you agree to Divorce if your heart says so or else wait for him to come back & start loving you. However, one important point is that, he cannot marry any other Woman without Divorcing you.

dear queriest, The consequences of not replying to notice is not an offense under the law however one must bring on record the relevant facts/averments in his defense. in case no response is sent, and a legal action is initiated by the sender, the court may take adverse inference against the defaulting party, for more information about the same kindly call me .
