If a case is filed, it cannot be “closed” just like that unless: Both parties settle (mutual compromise), OR Court decides and disposes the case, OR The person who filed it withdraws (only in certain types of cases) So if your husband filed a case and is not closing it, it means: ➡️ The case is still active in court ➡️ You need to respond legally (ignore mat kariye)

Even if a case is pending between you and your husband, you can still proceed with a mutual divorce, provided both parties are willing to settle all disputes amicably. Regarding the pending case filed by your husband, it is advisable to include a clause in the settlement that both parties will withdraw or quash all existing cases against each other. In criminal matters, quashing can be done through the High Court after settlement.

If your husband has filed a case, it will continue unless withdrawn or disposed of by the court. If both of you agree for mutual divorce, you can file a joint petition in Family Court. In the settlement, both parties usually agree to withdraw or close all pending cases and settle issues like maintenance or custody.
