My husband filed child custody case...

No divorce case filed....already got my child thru HCP on aug 8 2021... I came out of my matrimonial house when my husband's brother beated me to death infront of my husband and he was still watching only...alonv with my in laws.... Iam working ..so shifted to my workplace.... Then after that my colleague started helping me.... Now he is telling, u r having affiar with ur colleague and jus by seeing messages and official places we stayed , he is threatening and applied for child custody case...... We hav no intimate pics ... nothing.... Still can my husband get my child from me ?.... As I already registered domestic violence case on his brother in police station without mentioning my husband and that case is still pending in social welfare inquiry stage for past 10 months.... ..kindly give me a solution

Hi there, first of all why you filed HCP? It implies that your child was not with you and your husband and you were already staying away from each other. when we're you married? Do you want to file divorce or want to live with your husband and child without any disturbances from your in-laws? pls give more details to help you

You do not need to worry about the child custody. To prove extramarital affair good evidence is necessary. Even if there is an affair that cannot be a ground for removing the child custody. Let the domestic violence case go in its own course. Your husband can get visitation rights only.
