If your husband has filed a divorce case and you have received a notice of it, then it is better to contest the said divorce case by filing your reply as a written statement and you can also claim maintenance, alimony etc. in the same case from your husband. Since you have already filed DV Case, No need to file any other case.

You have to answer the notice of divorce sent by your husband. whatever you have to reply that has to be done first and all the allegations made against you must be denied in your reply to his notice.

In case of divorce, the wife has a right to claim maintenance from her husband when she is unable to maintain herself financially. The fact whether the wife is working and earns some income or not, does not affect her right to claim maintenance from her husband.
