My husband deserted our family (my 2 kids and me) in Pune and is living in Chennai with his married

10-Apr-2023 (In Divorce Law)
My husband deserted our family (my 2 kids and me) in Pune and is living in Chennai with his married sister's family and mother. I sent a notice to my husband for separation and maintenance of children. To avoid any responsibility, my mother in law filed an FIR stating my husband is missing. He is not missing but Indian law doesn't take any active action against a missing person till 7 years. I have written to helplines, reached out to officials but no use through email ids on the internet. Can someone guide me which email id in the Police Department of Tamil Nadu addresses such issues that women face? And how does Indian Police penalize people for filing false FIR and abusing law? Can someone help me to whom to raise this situation to? And how to make him respond to the notice and work out on the maintenance for children?

Well, since your Hubby has not committed any Cognizable Offence, Police will not put efforts to arrest him or to trace about his whereabouts. You have to seek the assistance of a Spy to figure about the whereabouts of your Hubby and then once his known abouts will be known, you can file a case against him under Sec 125 of the CRPC for claiming maintenance from him for you and your child.

According to law you both have not been divorced. As he is your husband till now. you can further proceed and file a missing complaint of your husband in your jurisdiction. Then to if any kind of action is not been taken through police officer. File An Application under Section 154 CRPC . Further the court will take the cognizance
