my friend's wife is doing adultery

hindu religion sir my friend is got married 1 year back.now he got to know that his wife is in sexual relation with someone else, and he found all this info by installing mobile tracker software in her mobile and it is recorded that she is doing adultery.now my friend is very much depressed and he want anyhow divorce.so,1. what to do ?2.how much more evidence is required to safely getting divorce? 3.if she file dowery case and assault case which we did not then what will happen? note-they have more political and money power sir plz reply

These are not such a matters that can be solved on phone by this way. Initially you have to win the confidence of the girl so as to get the reason behind this, meanwhile can offer any family person for a councelling. Initial stage for these matter can be resolved by mediation and councelling.

If your friend is sure with proof about this fact that his wife is doing adultery and every possibilities have been gone from his hands than he can file a divorce petition under section 13 (1)(i) of the Hindu Marriage Act 1955 in family court. It is also note in your mind that mere proof of seen together or sitting or talking is not sufficient proof about illicit relations.

On the grounds of Adultery (sec 13 ) sub clause i - under Hindu Marriage Act 1955 . Your friend can file the case for divorce .Now burden of proving the adultery will be upon your friend , considering this you can collect the evidences which can stand in the court . In retaliation ; If the wife of your friend files cases under Domestic Violence Act 2005 ; 498 or 125 ; than it must be seen in the light of litigation if you file it firstly .
