Without full facts can't advice you the best.. First of all you have to check he took the statement by way of fraud or legally he summoned the bank official or its a joint account or single.. It's from bank or he got this from online banking... After all the queries I will be able to provide best information

this is a clear cut case of theft under section 379 of the IPC Thus the husband taking thing which belonged to his wife without her consent and with an intention to cause wrongfull damage you to her in the court proceedings, this act of the husband attracts section 379 of the IPC
