My friend want divorce from her husband. What is the procedure for it

As my friend has married before 4 yrs but her married life is not proper because her husband is drunkered person and beats her every days. So I want to Know that what is the procedure for divorce?

To take divorce you need to contact and consult a lawyer who has to send notice to the husband to initiate the proceedings in the family court. If you live in the metropolitan city there will be a separate family court or if you live in a town or a village or a semi urban city The civil court senior division has the powers of the family court. divorce can go in two ways either by mutual consent or without if it is by mutual consent then the case will finish off quite quickly but if it is without then it will be a contested case which can take a little bit of time.alternately if the husband is beating the wife then a criminal case can be filed against the husband in the local police station or a case of domestic violence can be filed by a lawyer directly in the court of law. also the wife who is the victim can file a case of maintenance(alimony) in the local court if she is unable to upkeep herself.

Your query is too short and no details r provided whether there are issues out of this wedlock etc. You may send a Notice through ur advocate and see if ur friend's husband accepts his fault and adjust ,understands and decides to lead a better life. Give him some time. Still if he does not the file petition for divorce. Contact ur local advocate and he will do the needful.

Dear client she have to first file complaint with women cell of police against husband for physical torture. Then she have to file domestic violence case for mental harassment. Then she can file divorce on the ground of cruelty. For any legal help call me

Hello,

The legal remedy for your friend would be that she needs to file for a Divorce Petition in the Family Court with the said grounds of her Husband being abusive and drunkard and that your friend cannot continue in the said Marriage.
