Then we received her 1st legal reply during navratri. and she had put some false allegations against Me, my brother, and my mother. she has mentioned in notice that she is ready to come to home. But she is not coming. problem is that she wants divorce she don't want to live with my brother. but she don't want to file Divorce. she is waiting for my brother to file petition for divorce, so that she can demand for mentaince. how can we take Legal advantage of her assets until she don't come to discuss? what to do next?nshould we file petition or not? How can we get out of this problem ASAP?

Ask her your brother to file a mutual consent divorce. specifically mention the things that she alleged towards your family in the particular draft. And as she aks for Maintainance .. tell your brother to put a oral submission towards court that you had sent a legal notice to come her back . she didn't replied towards that particular legal notice.. Since specific time she has left the house. And even right now before Court he is ready to take her home and want to have a happy married . As the allegations done by her in her notice were baseless and flase allegations

Well, you should file a Divorce Case on the ground of Illegal Desertion and Adultery. If you will be able to prove Illegal Desertion and Adultery, you do not have to pay Maintenance at all except Child Support. You do not have to pay Litigation Expenses too.
