Mutual when Annulment already filed Possible?

10-Apr-2024 (In Divorce Law)
Hi, I got married before 1 year. Now I have filed an Annulment in Hyderabad against my wife on the grounds of fraud (she has hidden the information about her medical health that she had Tuberculosis) . Now almost 2 hearings passed she didn't show up to court. So our advocate filed for ex parte and the case is now in evidence stage. Now she says she is willing for a mutual settlement but wants to be done at Bangalore court. Now my question is can we file for a divorce by mutual consent at a court while annulment is still going on in a different court? What would be the right thing to do in this situation? Pls advice

Your advocate might have already told you but let me iterate the same. women have upper hand in the matrimonial issues. She can file case from any part of India. if you skip annulment and file for a divorce then you have to pay her monthly maintenance and other packages that comes with divorce. This is costly. In annulment your monthly savings will remain in the bank. You have filed for annulment after 1 year of marriage and you had no idea about her TB in this one year. This reason may not be that convincing to the court but worth giving it a try. As I see hyderabad and Bangalore so I presume you both are software Engineers and filed it in Kukatpally Family court. This Kukatpally Family Judge may not get convinced but worth giving it a try for Annulment. Your money your life your decision now.
