11-Aug-2024 (In Divorce Law)
first sign of mutual divorce was done, i am in foreign country & gave power of attorney to father. After 4 months of first sign, she has put a condition either i will be in person in court for final sign or give double of the remaining amount (that is really high).shall i come for second sign or give the money? is it possible for her to change the conditions now ?as i am afraid to come to India now. What can be done ? we lived only for two months after wedding & i flew out of country.

Hello there! You don't need to bow down to her illegal demand as you are well protected by the law, sir. The law is clear that when the first motion is done and statements of parties are recorded before the court of law based upon the MOU/ settlement, the party which violates its conditions is liable to be prosecuted for the contempt of court. You may consult me though.

Hi, If the settlement has already been signed and first motion has been granted, then no one can change the terms of the said settlement agreement. She cannot put any conditions, either she will abide by the settlement agreement or she will have to bear the consequences.

Legally no one can change the terms and conditions of the agreement that is once drafted and signed by the parties. If you wish to come here in India you can always come and finish the matter. For more legal assistance I am just a call away.

It’s better you shouldn’t come bcoz she may implicate you in some false case and blackmail you future n which can create a hurdle ! You should rather have not given a single penny on first motion ! Kindly be in touch
