Mutual divorce case petition with settlement

28-Oct-2023 (In Divorce Law)
Hi me and ex partner initially filled two separate divorce cases in two different courts. Then later we came to know both of us filled and the judge gave us a solution since we both need divorce to cancel both the cases and go for mutual divorce with settlement. So i done settlement with my partner with both our signature in front of judge. And after we both withdrawn the original cases and to file mutual divorce with waiver of previous two cases. After everything is done now the ex partner is not coming to file mutual petition. What i can do? Please advise.

This happens in many cases. Now you need to file a fresh divorce petition narrating all the facts including the one where you were made to believe that your wife was willing for divorce by mutual consent. You can also send legal notice asking your wife to abide by her promise or else you will file a fresh divorce petition. This will give you good ground for contested divorce.

In this case, I would like to know any settlement is pending or you settled further you said two different places which court-based on your answer guide you to step up the issues. I have a vast practice in that area you can seek my assistance in your matter.
