Mutual divorce and allemoney and child's maintenance issue

I have planned to go for a mutual divorce just asking back my dowry moneny with no demand from husband.but I want him to settle my daughter who is 8yrs old.but in maintenance case for daughter he is telling that he don't have any source of income.ow can I proceed my mutual divorce with no demand.or can I wait till MC is finalised.coz he and family tortured me to the core so I can't leave him happily without doing anything atleast for my baby he has to settle.but at the same time I don't want to my entire life in court.i want peace of mind and happiness in my life.kindly help me
