For a mutual divorce with no or minimal alimony, both parties must mutually agree on all terms including alimony, child custody (if any), return of articles, and withdrawal of disputes. If both spouses are employed and financially independent, the court may permit divorce with nominal or even zero alimony based on settlement terms. Proper drafting of the Mutual Consent Divorce Petition and Settlement Deed is very important to avoid future disputes. Mutual consent divorce is possible with no alimony or minimal alimony, provided both parties voluntarily agree and the settlement terms are fair, lawful, and clearly recorded before the Family Court. Before proceeding, ensure that: • All financial claims, maintenance, streedhan, child custody/visitation and future liabilities are completely settled in writing • The settlement expressly mentions that both parties waive future claims, if mutually agreed • Consent is free from pressure, coercion or emotional manipulation • Payment terms and timelines are properly documented Do not sign any memorandum or affidavit casually. Once mutual consent terms are recorded and acted upon, reopening financial claims later becomes difficult. A properly drafted settlement deed is crucial to avoid future litigation or enforcement disputes.
