I am a female,30 years, Hindu. My husband,32, Hindu. We had an arranged marriage last year in the month of December 2023. We don’t want to live with each other as it is mutually decided between us because of our emotional incompatibility. We are seeking mutual divorce..how it can be filed? How much time it will take? As we are trying to get divorced ASAP.

Divorce by mutual consent is the easiest and most speedy way to take a divorce. It takes approximately one year or 9 months to complete the entire process. You need to file a mutual petition and there will be counselling and further the divorce is granted. Petition must include consent terms or agreements if any , agreed by the parties.

Well, if you guys have been living separately with each other for more than a year without having any Physical Relations with each other, then, you guys become compatible to apply for Mutual Divorce, if both of you mutually have decided to break your matrimonial tie.
