I stay in chennai my husband in pune we r separated since 10month if i file mutual divorce now can we get 6 month period waiver as we are ready to end it mutually asap

hey....you can get the cooling off period waived by preferring an application to that effect. we can lay down the reasons for getting the cooling off period waived and the court will consider such a request.

For filing mutual consent divorce petition, separation shall be of minimum 1 year and after filing of the petition 6 months period is mandatory and the waiver will be granted if there is any other pending case between husband and wife.

To initiate a mutual divorce in India, both spouses must provide written consent to the divorce. If the couple has children, they must also make arrangements for custody and visitation. Once consent is obtained, the couple must go through a court proceeding to finalize the divorce
