23-Sep-2026 (In Divorce Law)
Hi, My name is Karan, currently based internationally and have to file mutual consent divorce application with giving special power of attorney to my father. I've received the draft from wife's lawyer. I want to know how should this be done- Is online notary possible in this case? what is the process. PETITION FOR DISSOLUTION OF MARRIAGE BY MUTUAL CONSENT UNDER SECTION 13(B) OF THE HINDU MARRIAGE ACT, 1955 MEMO OF ADDRESSES (Pursuant to Order VI Rule 14-A of C.P.C.)

Online notarisation isn't accepted. Sign the SPA at the Indian Embassy/Consulate (or before a local notary with apostille), courier it, and get it stamped in India within 3 months. Ask the court to let you appear by video conference.

A Special Power of Attorney (SPA) signed abroad must be physically or locally notarized by a notary public in your current country, and then attested by the Indian Embassy or Consulate in that country. Once the physical or attested SPA reaches India via courier, it must be adjudicated, stamped, and registered locally in India (usually within 3 months of receipt) to have legal standing. Check with your Indian lawyer if your specific Family Court bench accepts video-identified or e-notarized documents, though physical consular attestation remains the safest route.
